Terms of Service

1. Acceptance of terms

By accessing or using Tracking Auditor at trackingauditor.io (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

Tracking Auditor is a web-based tool that connects to your Google Tag Manager and Google Analytics 4 accounts (via Google OAuth) to analyse your tracking setup and generate a scored audit report. On paid plans, the full report can be exported to your Google Drive as a Google Doc and Google Sheet. The free tier provides a preview of your audit (grade, dimension scores, and issue counts); full findings, fix plans, and exports require a paid plan.

The Service is provided for business use. By using the Service you confirm that you are acting in the course of a business, trade, or profession, and not as a consumer.

3. Your account and access

You must sign in with a Google account to use the Service. You are responsible for maintaining the security of your Google account. You must not share your login credentials with others.

You must have the legal right to access the Google Tag Manager and GA4 accounts you connect to the Service. Do not connect accounts you are not authorised to access.

4. Acceptable use

You agree not to:

  • Use the Service to access data you are not authorised to access
  • Attempt to reverse engineer, copy, or resell the Service
  • Use the Service in a way that violates any applicable law or regulation
  • Attempt to overload, disrupt, or circumvent the Service’s security
  • Use automated scripts to run audits at scale without prior written agreement

5. Payments and billing

Subscriptions are billed in advance on a monthly basis. Pay-per-audit purchases are charged at the time of purchase. Prices are shown in GBP (or your local currency at checkout); the final amount, including any applicable taxes, is shown at checkout before you pay.

Subscriptions renew automatically unless cancelled before the renewal date. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We do not offer pro-rata refunds for unused subscription time.

Pay-per-audit purchases are consumed when the full report is unlocked or the audit is run. Once consumed, they are non-refundable except where required by law. If a purchased audit fails to complete due to a fault in the Service, contact us and we will re-run it or refund it.

Payments are processed by Stripe. Depending on your location, your purchase may be made from Stripe acting as merchant of record on our behalf, in which case Stripe is responsible for calculating and remitting applicable sales taxes and your payment is also subject to Stripe’s consumer terms. We do not store your payment card details.

6. Accuracy of audit results

Tracking Auditor provides automated analysis based on data available via Google APIs. Audit results are informational and may not capture every issue with your tracking setup. We make no guarantee that the audit is exhaustive or that following the recommendations will achieve any particular outcome.

Many checks identify potential issues from configuration and naming patterns rather than from inspecting the underlying data. As a result, findings may include false positives, items flagged as a potential problem that, on investigation, do not apply to your setup, as well as issues that are not flagged. Findings are not legal, compliance, or professional advice, and a finding (or its severity) is not a determination that a violation or problem exists.

You are responsible for independently verifying findings before relying on them or making changes to your tracking configuration.

7. AI-generated content

Findings, recommendations, and action plans in your audit report are generated in part by Anthropic’s Claude AI. AI-generated content may occasionally be inaccurate or incomplete. You should review all recommendations before acting on them.

8. Intellectual property

The Service, including its code, design, and methodology, is owned by Tracking Auditor. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your own business purposes.

Audit reports generated by the Service are yours to use. You may share them with clients, include them in proposals, and use them for any lawful business purpose. Where you white-label a report under your own brand, you are responsible for how you present it to your clients and for any advice you give based on it.

9. Data and privacy

Our collection and use of your data is described in our Privacy Policy, which forms part of these Terms.

10. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.

Subject to the above, and to the maximum extent permitted by law, Tracking Auditor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, loss of data, loss of anticipated savings, or business interruption. In particular, we are not liable for decisions you or your clients make in reliance on audit findings, or for the state of any tracking setup the Service reports on.

Subject to the above, our total liability to you for all claims arising from use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Your responsibility to us (indemnity)

You agree to indemnify us against claims, losses, and costs (including reasonable legal fees) arising from: (a) your connection of Google accounts or properties you were not authorised to access; (b) your breach of these Terms; or (c) reports or advice you provide to your own clients based on the Service, including white-labelled reports presented under your brand.

12. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, misuse the Service, create multiple accounts to circumvent usage limits, or use it in a way that creates risk or possible legal exposure for us. Where practical, we will notify you and give you an opportunity to remedy the issue first.

You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and indemnity) survive it.

If we terminate your access other than for breach, we will refund any unused pay-per-audit purchases.

13. Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may suspend access for maintenance, security, or other operational reasons. We are not liable for any losses resulting from service unavailability. The Service also depends on third-party APIs (including Google APIs) that we do not control; we are not responsible for their availability or for changes Google makes to them.

14. Changes to terms

We may update these Terms from time to time. Material changes will be communicated by email or by a notice in the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
